Marcos Morales was an advisory lawyer of the Ministry of Economics, Intellectual Property Department, before becoming the Senior Lawyer and Head of the Legal Department of the same entity (1994-1996). As Head of such department, he was in charge of the proceedings and rulings of all litigations relating to trademarks and patents filed before the IP Department.
He participated in the special commissions set forth to study the possible consequences in our national legislation and IP system of the implementation of the TRIPS and Nafta agreements.
He has majored in IP specialization courses in both the University Robert Schuman, Strasburg (1995) and the University of London (1996).
Before joining Alessandri & Cia., he worked as an IP specialist in patent and trademark litigations at Silva & Cia., for a period of eleven years, during which he was named Partner of the law firm. He is a very sought out lawyer for providing Law Reports regarding trademark matters.
Since 2003 he is arbitrator of domain name dispute resolution proceedings set forth by NIC Chile, Registry in charge of all <.cl> domain names.
He has been invited and has participated as speaker and lecturer in many conferences, seminars and lectures related to his published books and specialization at Universities such as the University Diego Portales, University Adolfo Ibañez, University of Valparaiso, University of Chile, and Catholic University of the Saintliness Conception and University Central.
Marcos Morales has published a number of articles in IP magazines and law Journals in Chile and abroad, such as "La función de la mala fe en la prescripción de la acción de nulidad de marca comercial" (The role of bad faith in the prescription of annulments of trademarks - Estudios de Derecho Comercial, Universidad Católica del Norte, 2004); "La cancelación de registros de nombres de dominio en el sistema de la UDRP y análisis comparativo con el sistema chileno (comparative analysis between the cancellation of domain names via the UDRP and the Chilean Domain name dispute resolution system - Revista Chilena de Derecho Informático», Nº 6, Universidad de Chile, 2005); "Naturaleza jurídica de los nombres de dominio y sus consecuencias en el derecho chileno (Legal nature of a domain name and its consequences in chilean law - Derechos Intelectuales Nº 12, Asipi 2006), "Tratamiento de datos personales por parte de los organismos de la Administración del Estado" (Treatment of personal data given by State organizations -Revista Derecho Mayor Nº 1, Universidad Mayor, 2007).
He is the author of "El Delito de Acusación o Denuncia Calumniosa" (The crime of defamatory accusations and indictments - 1993) y "Derecho Marcario" (Trademark Law - 2001), an important reference for all IP lawyers. He is also the coordinator of the book "Temas Actuales de Propiedad Intelectual" (Current IP matters - 2006).
He is an active member of the Chilean Association of Industrial Property (ACHIPI) since 1997, representing such association in the commission that created the Law 20.160 that introduced important modification to the new Intellectual Property Law 19.039.
Marcos Morales is a member of the Chilean Bar Association.
